1. ACCEPTANCE OF TERMS

By accessing, downloading, or using SweatJoy.app ("the Service," "the App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must immediately discontinue use of the Service.

2. ELIGIBILITY

SweatJoy.app is intended exclusively for adults 18 years and older. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. ACCOUNT REGISTRATION & SECURITY

  • You must provide accurate, complete, and current information when creating an account
  • You are solely responsible for maintaining the confidentiality of your login credentials
  • You agree to notify us immediately at support@sweatjoy.app of any unauthorized use of your account
  • You are responsible for all activities that occur under your account
  • You agree to keep your registration information up to date and to promptly correct any information that becomes inaccurate or incomplete.

4. ELECTRONIC COMMUNICATIONS CONSENT

By creating an account, you expressly consent to receive electronic communications including:

  • Subscription confirmations and billing notices
  • Service updates and policy changes
  • Account security notifications
  • Renewal reminders and cancellation confirmations

These communications are an integral part of your relationship with SweatJoy.app. You may not opt out of service‑related communications (such as security notifications and transaction confirmations) while your account remains active.

5. SUBSCRIPTION AND PAYMENTS

SweatJoy offers auto-renewable subscription plans that provide access to premium wellness features, personalized programs, and exclusive content within the application.

Subscription Details

  • Auto-Renewal: All subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
  • Billing: Payment will be charged to your Apple App Store or Google Play Store account at the time of purchase confirmation.
  • Renewal Charges: Your account will be charged for renewal within 24 hours prior to the end of the current subscription period.
  • Management: Users can manage, modify, or cancel subscriptions at any time through their App Store / Play Store account settings.
  • Cancellation: Cancellation will take effect at the end of the active billing cycle. No refunds will be issued for unused portions of the subscription period unless required by law.
  • Free Trial: Any free trial period offered will automatically convert into a paid subscription unless cancelled before the trial period ends.
  • Price Changes: Subscription fees may be updated from time to time. Any price changes will be communicated in advance and will only apply to future billing cycles.

  • Monthly Plan: $19.99/month
  • Annual Plan: $214.99/year
  • Free Trial: 7 days for eligible new users 

Payment Processing

All subscription payments are securely processed through Apple’s App Store and Google Play Store. These transactions are subject to the terms, conditions, and policies of the respective platform providers. SweatJoy does not collect or store your credit card or payment details.

6. INTELLECTUAL PROPERTY

All content, trademarks, logos, software, and materials associated with SweatJoy.app are the exclusive property of SweatJoy.app or its licensors.

  • You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes only
  • You may not copy, modify, distribute, sell, lease, or reverse engineer any part of the Service without prior written consent
  • Any unauthorized use may result in immediate termination of your account

7. USER CONDUCT & ACCEPTABLE USE

You agree not to:

  • Use app for any unlawful purposes or activities
  • Share false, misleading, or harmful health or wellness information
  • Infringe on intellectual property rights of app or third parties
  • Attempt to disrupt, interfere with, or compromise the Service's functionality, servers, or networks
  • Create multiple accounts or share account credentials
  • Use automated systems or bots to access the Service

Violation of these rules may result in immediate suspension or termination of your account without refund.

8. USER CONTENT & LICENSE

User Content: The Service may permit you to post, upload, submit, store, or share content, including text, photos, videos, event listings, and other materials ("User Content").

  • Ownership:You retain any intellectual property rights that you hold in your User Content.
  • License to SweatJoy.app: By submitting User Content, you grant SweatJoy.app a worldwide, non‑exclusive, royalty‑free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and publicly display such User Content in connection with operating, providing, marketing, and improving the Service.
  • Your Representations:You represent and warrant that you have all rights necessary to grant this license and that your User Content does not infringe, misappropriate, or violate the rights of any third party or any law.

Community Moderation: We may, but are not obligated to, review, monitor, or remove User Content at our discretion, including where we believe it violates these Terms or may create risk of harm or liability.

9. COMPREHENSIVE DISCLAIMER OF WARRANTIES

SweatJoy.app is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory.

Health & Safety Disclaimer:
Physical activity, nutritional changes, and relaxation practices such as hypnosis or guided imagery involve inherent risks. You are solely responsible for determining whether to use the Service. You should consult with a physician or other qualified healthcare provider before beginning any new exercise, nutrition, or wellness program and before using hypnosis or similar techniques, particularly if you have a history of medical or mental health conditions. You agree to stop using the Service and seek medical attention immediately if you experience dizziness, fainting, shortness of breath, chest pain, or any other concerning symptoms.

Service Disclaimers:

  • Wellness Movement Suggestions: All movement and wellness suggestions are for general wellness purposes only and do not replace professional medical, wellness, or therapeutic advice.
  • Nutritional Meal Plans: Meal plan options are provided for informational purposes only and are not individualized medical or dietary prescriptions.
  • NLP Hypnosis Sessions: Recorded hypnosis sessions are for relaxation and general wellness purposes only and are not medical, psychological, or therapeutic treatment.
  • Tracking Features: All eco‑system tracking features are intended for self‑monitoring only and do not substitute for professional medical, psychological, or nutritional advice.
  • Community Meetups: SweatJoy.app does not organize, endorse, or supervise local events posted by users or businesses.We do not conduct background checks on users or verify locations, organizers, or participants. You are solely responsible for your interactions with other users and your decision to attend any meetups.

We make no warranties regarding accuracy, reliability, availability, or wellness for any particular purpose.

10. LIMITATION OF LIABILITY

Assumption of Risk:
You understand and agree that your use of the Service, including any physical activities, nutritional changes, hypnosis sessions, and participation in community meetups, involves inherent risks, including risk of physical or psychological injury. To the fullest extent permitted by law, you voluntarily assume all such risks arising out of or related to your use of the Service.

Health and Safety: SweatJoy.app provides wellness, nutrition, hypnosis, and wellness content for informational purposes only. We are not responsible for injuries, damages, or losses resulting from your use of the Service.

Community Meetups: Participation in any local events or meetups posted through the Service is entirely voluntary and at your own risk. SweatJoy.app disclaims all liability for injuries, damages, or disputes arising from participation in such events or interactions with other users.

Maximum Liability: To the fullest extent permitted by law, SweatJoy.app and its affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, even if advised of the possibility of such damages.

Sole Remedy: Your sole and exclusive remedy for dissatisfaction with the Service is to discontinue use of SweatJoy.app.

Non‑Excludable Liability: Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, including certain liabilities for personal injury caused by our gross negligence or willful misconduct where such limitations are not permitted.

11. TERMINATION

We reserve the right to suspend or terminate your account immediately, without notice and without refund, if you violate these Terms or engage in conduct harmful to SweatJoy.app, its users, or third parties. We may also terminate or suspend the Service, or any portion of it, at any time, with reasonable notice where practicable.

12. MANDATORY ARBITRATION & DISPUTE RESOLUTION

Governing Law: These Terms are governed by the laws of the State of Nevada, United States.

Mandatory Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration under the rules of the American Arbitration Association, conducted in Clark County, Nevada.

Class Action Waiver: You expressly agree that disputes will be resolved on an individual basis only and not as part of any class action, collective action, or representative proceeding.

Exception:

Either party may seek injunctive relief in state or federal courts located in Clark County, Nevada.

Either party may bring an individual claim in small claims court if the claim qualifies.

13. GLOBAL COMPLIANCE

SweatJoy.app is accessible worldwide. Users outside the United States may have additional rights under local laws, including GDPR (EU/UK) and

CCPA (California). SweatJoy.app will respect applicable data protection rights as outlined in our Privacy Policy.

14. MODIFICATIONS TO TERMS

We may update these Terms at any time. Changes will be posted on SweatJoy.app with a revised effective date. Continued use of the Service after changes constitutes acceptance of the updated Terms. If we make material changes that affect your rights, we will provide additional notice (such as by email or in‑app notification) where required by law.

15. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SweatJoy.app regarding your use of the Service and supersede all prior agreements.

17. SUBSCRIPTION CANCELLATION

To cancel your subscription:

iOS Users:

  1. Open Settings on your iPhone
  2. Tap your Apple ID
  3. Tap Subscriptions
  4. Find SweatJoy and tap it
  5. Tap Cancel Subscription

Android Users:

  1. Open Google Play Store
  2. Tap Menu > Subscriptions
  3. Find SweatJoy
  4. Tap Cancel subscription
